CONDITIONS OF SALE
These conditions contain important terms which govern your business relationship with Elevate Dancewear Ltd. Therefore please read them carefully and keep the supplied copy available for reference.
1.1 In these Conditions:
“Elevate” means Elevate Dancewear Limited:
“The Customer” means any person, undertaking, buying or offering to buy Goods from Elevate:
“Goods” means all products supplied by Elevate:
2.1 Orders are taken on receipt of a telephone call, internet, email or by personal callers to our showroom/stand.
2.2 Ownership of the goods remains with Elevate until full payment is received from the customer for those said goods.
2.3 A 50% Deposit of the Total Estimated Quote must be paid ahead of materials being ordered. Delays in payment will affect estimated delivery dates at the customer’s risk. With final payment being invoiced upon completion.
2.4 Payment will be made by the customer within 30 days of the final invoice date, by Bank Transfer. Payments will be made without any deductions, offset or counter claim without the prior consent of Elevate and Late payment will bear interest of 5% per month upon the sum that is not paid after the 30 day period.
2.5 Where Elevate have to elect a third party to recover monies due, Elevate shall be entitled to recover any cost thereof in full, from the customer.
3 Orders & Specifications
3.1 Any design specifically produced by Elevate and any specifications supplied by the customer, in connection to the purchase of goods together with the copyright, design right or any other intellectual property rights, shall be the exclusive rights of Elevate.
3.2 Elevate shall not be liable in respect to any alleged defect in the goods as a result of any specifications made by the customer against the advice of Elevate.
3.3 Elevate may from time to time have to adjust its product specification without prior notification.
3.4 Once Elevate have received a customers order, this will be prepared. Once preparation has been commenced the order cannot be cancelled in any way.
3.5 Due to colour sensitivity in fabrics Elevate cannot guarantee Colour Fastness in any product.
4.1 Elevate may without prejudice suspend or cancel delivery of goods if the customer is in breach of its contractual obligations with regard to the payment terms.
4.2 Elevate will as far as possible attempt to meet orders received and accepted. All orders are accepted conditionally upon the availability of the goods ordered, and Elevate shall not be liable for failure to meet any order or part thereof for any reason whatsoever.
4.3 Any dates quoted for delivery are approximate and Elevate shall not be liable for any delays in delivery howsoever caused.
4.4 The Risk in Goods will pass on Delivery. Carriers require that all claims be notified in writing within 7 days of the receipt of goods and non deliveries be notified within 14 days of the date of dispatch, for overseas deliveries 21 days. Claims notified after these periods will not be recognised.
4.5 Where so determined Elevate shall use an insured/trackable “signed for” means of delivery. If the customer wishes an alternative untrackable service the customer will be solely responsible for any loss.
5.1 Elevate may from time to time have to adjust its catalogue prices without prior notification.
5.2 All prices exclude VAT and dispatch charges. VAT will be added (where applicable) to the total order including carriage & packing. VAT does not apply if the goods are being sent outside of the EC. Carriage costs are dependent on the size of your order, the destination and service used.
5.3 Elevate require 50% of the quote on all bespoke goods at time of order with the balance due on or prior to collection. All other goods are to be paid for in full customer at the time of placing the order.
5.4 In the event that payment is not made Elevate have the right to withhold delivery of any further goods.
5.4.1 In this instance Elevate will require pre-payment on all future orders.
6.1. All Goods may be returned for exchange if they are found to be faulty, within 5 days of receipt of the goods. If goods are returned because the wrong size has been ordered, postage will be charge for the return item.
6.2 Underwear cannot be exchanged.
6.3 Should Elevate deliver goods incorrectly then Elevate will reimburse the return postage cost at the equivalent of Royal Mail’s 1st Class Letter Service at the prevailing rate. Elevate will re-deliver the replacement goods Post free. All returns must be authorised by Elevate via email before any goods are returned.
6.4 Goods are returned for exchange at the customer’s cost.
6.5 Goods must be returned without the tamper tag removed. Any returns with Wear Marks or without the tamper tag in tact will not be accepted for exchange or credit by Elevate.
6.6 Any claim based on a defect in quality or condition of goods supplied or failure to correspond with specifications must be notified to Elevate within 21 days of receipt of goods. In the event that the fault is accepted Elevate will replace the goods free of charge subject to availability.
6.7 It is advisable for “Proof of Posting” to be obtained.
6.8 General Return Conditions
In order for a return to be accepted, it must meet the following conditions:
6.8.1 The product must be unused and unworn.
6.8.2 The product must be in its original state and packaging.
6.8.3 Goods must have the original tags attached.
6.8.4 Accessories must have all parts of the original packaging.
6.9 Below products are excluded from returns:
6.9.1 Customised and personalised products, except in case of manufacturing defects.
6.9.2 Toiletries, except in case of manufacturing defects
7 Dealing with Goods
7.1 The customer shall not employ a third party to onward sell Elevate goods purporting to be an employee or agent of Elevate without the authorisation of Elevate.
8 Warranties & Liabilities
8.1 Elevate warrants that the goods sold will correspond with their description in the current Elevate catalogue.
8.2 Elevate shall be under no liability in respect to any defect arising from fair wear & tear, customer negligence, wilful damage, abnormal working conditions, failure to follow Elevate’s instructions (written or oral). Misuse or alteration/repair of the goods without Elevate’s approval.
8.3 Elevate shall be under no liability as to the quality of the goods beyond the occasion of their first use.
8.4 Elevate do not guarantee colours to be identical to that appearing in their catalogues or website. Slight colour variation may occur due to variations in dye lots.
8.5 Elevate do not guarantee their products to the fitness for the purpose intended by the customer. It is the customers’ responsibility to ensure that the goods are suitable for their own purpose.
8.6 The customer’s statutory rights are not affected by these terms & conditions.
9.1 All correspondence/notices shall be addressed to either parties registered office or principal address that we have on record at the time.
9.2 No waiver by Elevate of any breach of the contract by the customer shall be considered as a waiver of any subsequent breach of the same or any other provision.
9.3 This contract shall be enforceable by the laws of England and will be settled as such in the courts of England.
ACKNOWLEDGEMENT by receiving these terms & conditions it is implied that the customer agrees and abides by them.
10 Method of Payment

10.5 Diners not accepted
When sending payments from overseas, ALL CHARGES must be paid by yourself so that Elevate receive the full funds required.
Please send full details with your payments, and please make sure you send us details of what your payment is for.
11 No other foreign currencies are accepted. This is due to the high handling charges levied by our bank.
